These Terms and Conditions apply to the use of the Apex Podiatry website and to appointments, consultations, treatments and other podiatry services provided by Apex Podiatry.

Please read these Terms and Conditions carefully before requesting or confirming an appointment.

1. About Apex Podiatry

Apex Podiatry is operated by Mala Sian, trading as Apex Podiatry (“Apex Podiatry”, “we”, “us” or “our”).

Our podiatry services are led by Mrs Mala Sian, Advanced Practitioner Podiatrist, HCPC Registration No. CH31444.

2. Scope of These Terms

These Terms and Conditions apply to:

  • home-visit podiatry appointments;
  • initial video consultations;
  • assessments;
  • podiatry treatments;
  • follow-up appointments;
  • communications relating to appointments and treatment;
  • use of the Apex Podiatry website; and
  • any other private podiatry services that we agree to provide.

References to “you” include the patient receiving treatment and, where appropriate, a person who makes a booking on the patient’s behalf.

Where somebody makes a booking on behalf of another person, that person is responsible for providing accurate information and ensuring, where appropriate, that the patient is aware of the appointment and is able to provide valid consent to the proposed assessment or treatment.

3. Our Services

Apex Podiatry provides mobile podiatry services and related consultations.

Services advertised on our website include treatment and assessment relating to:

  • toenail care;
  • corns and calluses;
  • verrucae;
  • ingrown toenails;
  • diabetic foot health;
  • foot pain;
  • paediatric foot conditions;
  • fungal foot conditions;
  • foot ulcers; and
  • other foot-health conditions which fall within our professional scope of practice.

The treatment appropriate for an individual patient will be determined following appropriate clinical assessment.

The fact that a particular treatment or condition is described on our website does not mean that the treatment will necessarily be appropriate or available for every patient.

We may recommend a different treatment, further investigation, an in-person assessment, onward referral or medical attention where clinically appropriate.

4. Professional and Clinical Standards

Podiatry services will be provided with reasonable care and skill and in accordance with applicable professional and legal requirements.

Clinical decisions are made on an individual basis having regard to the information available at the time of assessment, the patient’s circumstances and the practitioner’s professional judgement.

Nothing in these Terms and Conditions is intended to restrict any statutory rights that a patient has in relation to services supplied by us.

5. Booking an Appointment

Appointment requests may be submitted through our website or made using the contact methods made available by Apex Podiatry.

Submitting an appointment request does not by itself guarantee an appointment.

After receiving a request, we will normally contact you with:

  • proposed appointment dates and/or times;
  • the proposed service or consultation;
  • the applicable charge or an estimate of the charge where appropriate; and
  • any further information reasonably required before the appointment.

An appointment becomes confirmed when the proposed appointment has been accepted by you and any payment or other confirmation required by Apex Podiatry has been received.

Where we offer an appointment for confirmation, the appointment should normally be confirmed within 24 hours. If confirmation is not received within that period, we reserve the right to release the appointment to another patient.

For urgent health concerns, patients should not rely solely on the website booking form or email.

6. Appointment Times

Due to the nature of a mobile healthcare service, appointment and arrival times may be provided as approximate times or time windows rather than guaranteed exact arrival times.

We will make every reasonable effort to attend within the agreed appointment period.

Delays may occasionally occur because of circumstances including:

  • previous appointments requiring additional clinical time;
  • traffic or road conditions;
  • road closures;
  • medical emergencies;
  • adverse weather;
  • vehicle problems;
  • illness;
  • circumstances at another patient’s appointment; or
  • other events outside our reasonable control.

We ask patients to allow reasonable flexibility around home-visit appointment times.

Where we become aware of a significant delay, we will make reasonable efforts to inform you.

If a substantial delay attributable to us makes it impractical for the appointment to proceed, we will endeavour to rearrange the appointment at a mutually convenient time without applying a patient cancellation charge.

7. Appointment Duration

Appointment duration will depend upon the service required and the patient’s clinical needs.

A standard appointment is usually approximately 30 minutes, unless otherwise stated. Travel and treatment time may form part of the time allocation or pricing structure where this has been stated in the quotation or booking information.

Some treatments may require longer.

Where it becomes apparent during an appointment that additional time or treatment is likely to be required, we will explain this to you as soon as reasonably practicable and, where an additional charge would apply, obtain your agreement before proceeding with additional chargeable services wherever practicable.

8. Home Visits and Service Area

Apex Podiatry provides home visits across parts of Buckinghamshire and the London Borough of Hillingdon and surrounding areas.

Areas currently served include locations such as:

  • Gerrards Cross;
  • Iver;
  • Denham;
  • Chalfont St Peter;
  • Chalfont St Giles;
  • Seer Green;
  • Amersham;
  • Uxbridge;
  • Harefield;
  • Ickenham;
  • Ruislip;
  • Beaconsfield;
  • Slough;
  • Langley; and
  • High Wycombe.

This list is not exhaustive.

If your location is outside the areas listed on our website, we may still be able to provide a home visit. Availability and any applicable travel charge will be confirmed before the appointment.

Service areas may change from time to time.

9. Prices and Quotations

Charges for home visits and treatment may vary depending upon factors including:

  • the patient’s location;
  • travelling time;
  • the treatment required;
  • the complexity of the condition;
  • the anticipated duration of the appointment;
  • equipment or clinical materials required; and
  • any additional treatment agreed with the patient.

Where practicable, we will provide the price or an estimate before confirming the appointment.

Prices quoted will be the price payable for the services described in the quotation unless additional services or treatment are subsequently agreed.

If circumstances arise during an appointment that make additional treatment advisable, we will explain the additional treatment and any additional charge before carrying it out wherever reasonably practicable.

Nothing in these Terms permits Apex Podiatry to impose an undisclosed mandatory charge after a booking has been agreed.

10. Video Consultations

Apex Podiatry currently offers an initial consultation by video call, including through WhatsApp Video or Zoom, where appropriate.

The current advertised fee for an initial video consultation is £25, unless a different price is confirmed before booking.

A video consultation will normally last approximately 15 minutes.

A video consultation is intended to provide a preliminary assessment and an opportunity to discuss symptoms, treatment options and appropriate next steps.

Because a video consultation does not permit the same physical examination as an in-person appointment:

  • a definitive diagnosis may not always be possible;
  • some conditions cannot be assessed adequately by video;
  • treatment cannot necessarily be recommended or provided on the basis of the video consultation alone; and
  • an in-person assessment, home visit, GP assessment, specialist referral or other healthcare assessment may be recommended.

The fee for the video consultation remains payable for the professional consultation provided even where an in-person appointment or further assessment is subsequently recommended.

11. Technology Requirements for Video Consultations

For a video appointment, you are responsible for having:

  • a suitable internet connection;
  • a compatible computer, tablet or mobile telephone;
  • the relevant WhatsApp or Zoom software where required;
  • a working camera and microphone; and
  • appropriate permissions enabled on your device.

You should, where possible, participate from a private and suitably lit environment in which the relevant area can be viewed safely.

If a consultation cannot proceed because of a technical failure on the patient’s equipment, connection or software, we will make reasonable efforts to resolve the issue or rearrange the consultation.

WhatsApp and Zoom are third-party services and their own terms, privacy practices and technical availability are outside Apex Podiatry’s direct control.

12. Payment

Unless otherwise agreed, payment must be made in full within 24 hours of the appointment.

Payment should be made by the payment method specified by Apex Podiatry.

Apex Podiatry reserves the right to require:

  • full payment in advance;
  • a deposit; or
  • payment before travelling to or attending an appointment,

where we reasonably consider this appropriate.

Where advance payment is required, we will tell you before the appointment is confirmed.

An appointment may be treated as unconfirmed until any required advance payment has been received.

13. Overdue Payments

You are responsible for paying invoices by the payment deadline communicated to you.

If payment becomes overdue, we may:

  • issue payment reminders;
  • contact you to request payment;
  • decline to accept further non-urgent bookings until outstanding sums are paid; and
  • where necessary, take reasonable steps to recover sums lawfully due to us.

Any additional recovery costs, interest or court costs will only be sought to the extent that they are reasonable, proportionate and legally recoverable.

Nothing in this section affects your right to dispute an invoice genuinely and reasonably where you believe that an amount has been charged incorrectly.

14. Patient Cancellation and Rescheduling

We understand that appointments occasionally need to be changed.

Where possible, please provide at least 24 hours’ notice if you need to cancel or rearrange an appointment.

More than 24 hours’ notice

No cancellation charge will normally be made where more than 24 hours’ notice is provided.

Less than 24 hours’ notice

Where an appointment is cancelled or rearranged with less than 24 hours’ notice, we may charge up to the full fee for the reserved appointment.

Any cancellation charge will be applied reasonably and will reflect the loss caused by the late cancellation, taking account where appropriate of:

  • time that had been reserved for the patient;
  • travel arrangements already made;
  • costs already incurred;
  • whether the appointment could reasonably be offered to another patient; and
  • costs saved because the appointment did not proceed.

We will not seek to recover more than our reasonable loss resulting from the cancellation.

15. Missed Appointments and Failure to Provide Access

If we attend at the agreed address and are unable to carry out the appointment because:

  • the patient is unavailable;
  • nobody provides access;
  • an incorrect address has been supplied;
  • access has not been arranged;
  • the patient declines the appointment after our arrival without a clinical reason attributable to us; or
  • the premises are unsuitable or unsafe,

the appointment may be treated as a late cancellation.

A charge of up to the applicable appointment fee may therefore be payable, subject to the principles in section 14 above.

We will make reasonable attempts to establish contact before treating an appointment as missed.

16. Cancellation or Rescheduling by Apex Podiatry

We may cancel, postpone or rearrange an appointment where it is reasonably necessary to do so.

Reasons may include:

  • practitioner illness;
  • medical emergencies;
  • unsafe conditions;
  • severe weather;
  • significant travel disruption;
  • vehicle breakdown;
  • equipment failure;
  • unforeseen clinical circumstances;
  • circumstances at a previous appointment; or
  • other events outside our reasonable control.

We will provide as much notice as reasonably possible and will endeavour to offer an alternative appointment.

Where we cancel an appointment and the service has not been supplied, any advance payment relating solely to that appointment will be refunded or, with your agreement, credited towards a replacement appointment.

17. Your Responsibility to Provide Accurate Information

You must provide information that is accurate and complete to the best of your knowledge.

This includes relevant information concerning:

  • your symptoms;
  • medical conditions;
  • medication;
  • allergies;
  • previous treatment;
  • diabetes or other relevant health conditions;
  • current infections;
  • recent surgery or hospital treatment;
  • relevant changes in your health; and
  • any information that may materially affect treatment or clinical decision-making.

You should tell the practitioner if any information previously supplied has changed.

Failure to disclose relevant information may affect the practitioner’s ability to assess or treat you safely.

18. Consent to Assessment and Treatment

Treatment will only be provided where appropriate consent has been obtained.

Before undertaking treatment, the practitioner may explain:

  • the proposed assessment or treatment;
  • material risks where relevant;
  • anticipated benefits;
  • reasonable alternatives;
  • consequences of declining treatment; and
  • appropriate aftercare.

You may ask questions at any time.

You may withdraw consent to a proposed treatment before or during treatment.

Withdrawal of consent will not affect charges properly due for assessment or treatment already provided.

19. Children, Young People and Patients Requiring Assistance

When an appointment concerns a child or young person, we may require a parent, guardian or other person with appropriate authority to be present or otherwise involved in decisions regarding treatment.

Where an adult may not be able to make a particular treatment decision independently, we will act in accordance with applicable consent and capacity requirements and may require involvement from an appropriate representative, carer, attorney or other authorised person.

Booking an appointment on another person’s behalf does not automatically give the person making the booking authority to consent to treatment for that patient.

20. Carers, Family Members and Other Persons Present

Patients may have a carer, family member or other person present during a home appointment where appropriate.

We may ask the patient whether they consent to another person being present while confidential health matters are discussed.

Where appropriate, we may request privacy for part of an assessment or consultation.

21. Access to the Property

For home appointments, you are responsible for ensuring that:

  • the address provided is correct;
  • access to the property is reasonably available;
  • any entry code, parking instructions or access arrangements have been provided in advance where necessary;
  • the practitioner can enter and leave the premises safely; and
  • the area in which treatment will take place is reasonably suitable for the service.

Where parking restrictions or unusual access arrangements may materially affect the visit, please inform us before the appointment.

22. Safe Working Environment

Apex Podiatry is committed to providing services safely and professionally.

We may postpone, stop or refuse to provide a service if we reasonably believe that doing so is necessary to protect the health, safety or welfare of:

  • the patient;
  • the practitioner;
  • a carer;
  • another person present; or
  • the public.

Examples may include:

  • threatening, abusive or violent behaviour;
  • an unsafe physical environment;
  • uncontrolled animals;
  • significant infection risks;
  • dangerous access;
  • exposure to hazardous substances; or
  • another material health or safety concern.

Where practicable, we will explain the concern and give the patient an opportunity to resolve it.

23. Pets and Animals

Where an appointment takes place in a patient’s home or other premises, animals should be appropriately secured where they may:

  • interfere with treatment;
  • distract the patient or practitioner;
  • contaminate the treatment area;
  • damage equipment; or
  • create a health or safety risk.

If an animal makes the environment unsafe or unsuitable, we may ask for it to be moved or secured before treatment can begin or continue.

24. Illness and Infection

Please inform us before an appointment if you or another person at the premises has a contagious illness or other condition that may present a material infection risk.

Depending upon the circumstances, we may recommend postponing the appointment or taking additional precautions.

Apex Podiatry may postpone an appointment where this is reasonably necessary for infection prevention or patient/practitioner safety.

25. Clinical Judgement and Referrals

A podiatrist may decide that:

  • a requested treatment is not clinically appropriate;
  • further assessment is required;
  • treatment should be delayed;
  • another healthcare professional should be consulted;
  • the patient should contact their GP;
  • specialist treatment is required; or
  • urgent medical assessment is appropriate.

We reserve the right not to provide a particular treatment where the practitioner reasonably considers that it would be unsafe, inappropriate, outside their professional scope of practice or contrary to the patient’s interests.

26. Treatment Results

Healthcare outcomes vary between patients.

Although services will be provided with reasonable care and skill, Apex Podiatry cannot guarantee:

  • that a condition will be completely resolved;
  • a particular treatment outcome;
  • that symptoms will not recur;
  • the length of time required for recovery; or
  • that additional treatment will not be required.

Some conditions require a course of treatment, self-care, further investigation or treatment from another healthcare professional.

Nothing in this section excludes our responsibility to exercise reasonable professional care and skill.

27. Aftercare and Patient Instructions

Where aftercare instructions or recommendations are provided, patients are responsible for following those instructions so far as reasonably possible.

You should contact Apex Podiatry or another appropriate healthcare professional if:

  • symptoms materially worsen;
  • unexpected complications occur;
  • you are concerned about your recovery; or
  • you require further clinical advice.

If a situation is a medical emergency, you should seek appropriate emergency medical assistance rather than waiting for a response from Apex Podiatry.

28. Emergencies

Apex Podiatry is not an emergency medical service.

Website forms, emails, voicemail and routine appointment requests should not be used where immediate medical attention is required.

If you believe there is a serious or life-threatening medical emergency, call 999.

For urgent medical advice that is not immediately life-threatening, patients may use an appropriate NHS urgent-care service such as NHS 111, where applicable.

29. Personal Data, Confidentiality and Clinical Records

Providing healthcare services requires us to collect and process personal information, which may include health information and other sensitive personal data.

We will handle patient information in accordance with applicable data-protection and confidentiality requirements and our Privacy Policy.

Our Privacy Policy should be read alongside these Terms and Conditions.

Clinical information may be recorded where reasonably necessary for assessment, treatment, continuity of care, professional record keeping, safeguarding, legal obligations or other lawful healthcare purposes.

Information will only be shared where there is an appropriate lawful basis for doing so, including where:

  • the patient has authorised the disclosure;
  • sharing is reasonably required for their care;
  • there is a legal obligation;
  • safeguarding considerations apply; or
  • disclosure is otherwise permitted or required by law.

30. Communication by Email, Telephone and Electronic Services

By providing contact details, you authorise us to use those details for reasonable communications connected with:

  • your enquiry;
  • appointment administration;
  • appointment reminders;
  • treatment;
  • payment;
  • follow-up care; and
  • other necessary service communications.

Because ordinary email, telephone networks, WhatsApp, Zoom and other communications services may be operated by third parties, their operation and security cannot be controlled entirely by Apex Podiatry.

We will nevertheless take reasonable steps to maintain patient confidentiality when using electronic communications.

31. Complaints and Concerns

We aim to provide a professional and high-quality service.

If you have a concern about an appointment, treatment, charge or other aspect of the service, please contact us as soon as reasonably possible so that we have an opportunity to investigate and respond.

We will endeavour to deal with complaints fairly, professionally and within a reasonable time.

Nothing in this complaints procedure prevents a patient from exercising any statutory right or from contacting an appropriate professional, regulatory or legal body where applicable.

Concerns specifically relating to the fitness to practise of an HCPC-registered professional may be raised with the Health and Care Professions Council in accordance with the HCPC’s procedures.

32. Liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or restricts liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;
  • fraud or fraudulent misrepresentation;
  • breach of statutory rights that cannot lawfully be excluded; or
  • any other liability that cannot lawfully be excluded or limited.

Where Apex Podiatry breaches these Terms or fails to exercise reasonable care and skill, we are responsible for loss or damage that is a reasonably foreseeable consequence of that breach, subject always to applicable law.

We are not responsible for losses that arise solely because a patient:

  • provides materially inaccurate or incomplete information;
  • does not follow reasonable clinical advice or aftercare instructions;
  • delays seeking appropriate medical assistance;
  • uses medication or treatment contrary to instructions; or
  • experiences a consequence which could not reasonably have been avoided by the exercise of appropriate professional care.

This section does not remove or reduce any legal responsibility Apex Podiatry would otherwise have for its own negligence or breach of duty.

33. Circumstances Beyond Our Reasonable Control

We will not be responsible for a failure or delay in providing a service to the extent that it is caused by circumstances genuinely outside our reasonable control.

These may include:

  • severe weather;
  • flooding;
  • major traffic disruption;
  • road closures;
  • accidents;
  • public emergencies;
  • sudden illness;
  • interruption to utilities or communications;
  • widespread technology failure;
  • government restrictions; or
  • other comparable unforeseen events.

Where this occurs, we will make reasonable efforts to notify affected patients and rearrange the service where appropriate.

This clause does not affect any right to a refund for a service which Apex Podiatry cancels and does not provide.

34. Use of the Apex Podiatry Website

The information on the Apex Podiatry website is provided for general information concerning podiatry, foot health and our services.

Website content is not a substitute for an individual clinical assessment.

You should not use general website information to diagnose a condition yourself or to delay obtaining appropriate professional medical advice.

We make reasonable efforts to keep website information accurate and current, but medical information, service availability, prices and other content may change.

35. Website Availability

We do not guarantee that the website will always be available or free from interruption.

We may temporarily suspend, withdraw or modify all or part of the website for maintenance, security, technical or operational reasons.

We are not responsible for a failure to receive an appointment request where the failure results from an internet, website or communications problem outside our reasonable control.

If you do not receive confirmation of a booking request, you should contact us directly.

36. Intellectual Property

Unless otherwise stated, the text, branding, layout, photographs, graphics and other original content on the Apex Podiatry website are owned by or licensed to Apex Podiatry.

You may view and print reasonable extracts for your own personal, non-commercial use.

You must not reproduce, republish, commercially exploit or substantially copy website content without permission where doing so would infringe applicable intellectual-property rights.

37. Links and Third-Party Services

Our website or communications may contain links to third-party websites or make use of services operated by third parties.

These may include services such as WhatsApp and Zoom.

Apex Podiatry does not control third-party websites or services and is not responsible for their independent content, terms, privacy policies, availability or security.

The inclusion of a third-party link does not necessarily constitute an endorsement of everything provided by that third party.

38. Changes to Services and Prices

We may change:

  • the services we provide;
  • geographical coverage;
  • appointment availability;
  • standard prices; or
  • the way in which future appointments are administered.

Any price or service already specifically agreed for a confirmed appointment will not normally be changed retrospectively unless:

  • you agree to the change;
  • additional services are requested or agreed;
  • the original information supplied was materially incorrect; or
  • a change is required by law.

39. Changes to These Terms and Conditions

We may review and update these Terms and Conditions from time to time.

The version that applies to an appointment will ordinarily be the version made available to you when the appointment is confirmed.

Changes will normally apply only to future bookings and will not retrospectively alter an existing agreed appointment unless:

  • the patient agrees;
  • the change is required by law; or
  • the change does not materially disadvantage the patient and is reasonably necessary.

The latest version will be published on our website with the date on which it was last updated.

40. Acceptance of These Terms

You should be given a reasonable opportunity to read these Terms and Conditions before an appointment is confirmed.

By confirming an appointment, making any required payment and/or proceeding with the booked service after these Terms have been made available to you, you acknowledge that the appointment is subject to these Terms and Conditions.

Where booking is made through the website, you may be asked to confirm explicitly that you have read and agree to these Terms and Conditions.

Your statutory rights are not affected.

41. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

42. No Waiver

If Apex Podiatry does not immediately enforce a right under these Terms, that does not mean that the right has been waived.

Similarly, allowing additional time for a patient to comply with an obligation on one occasion does not automatically change the Terms for future occasions.

43. Third-Party Rights

Unless expressly stated otherwise, a person who is not a party to the agreement between Apex Podiatry and the patient does not have a right to enforce these Terms.

This does not affect any rights which another person may have independently under applicable law.

44. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising from them are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory rights regarding where legal proceedings may be brought which apply to you under law.
